Liability Waiver

E-bike repair, installation, upgrades, conversion, tuning, custom modification, diagnostics, test riding, battery handling, charging, storage, and use of modified vehicles involve risks. This Liability Waiver explains important customer responsibilities, risk assumptions, and liability limitations related to Picarlo products and services.

Picarlo is operated by AVNU Corporation and provides e-bike parts, upgrade kits, repair, installation, diagnostics, tuning, custom modification, and related services.

By purchasing products, requesting service, authorizing work, leaving a vehicle with Picarlo, accepting a serviced or modified vehicle, or using a Picarlo product or service, you acknowledge that you have read and understood this Liability Waiver to the extent applicable.

1. Purpose and Scope

This Liability Waiver applies to Picarlo products and services, including e-bike repair, diagnostics, installation, upgrades, conversion kits, controller and motor work, battery-related support, electrical work, performance setup, tuning, custom modification, limited test rides, vehicle handling, and other related services.

This website version is a general notice only. Picarlo may require a separate signed Service Authorization & Liability Waiver, High-Power / Off-Road Acknowledgment, Customer-Supplied Parts Acknowledgment, Battery & Charger Safety Acknowledgment, Pickup / Delivery Acceptance Form, or other document tied to the specific customer, vehicle, order, and work performed.

2. General Risk Notice

You understand that e-bikes and modified electric vehicles involve mechanical, electrical, battery, speed, handling, and riding risks.

Repair, tuning, or modification may change how a vehicle accelerates, brakes, turns, climbs, handles weight, transfers power, generates heat, or responds to rider input.

Risks may include, but are not limited to:

  • Loss of control, collision, falls, or crashes.

  • Longer braking distance or brake fade.

  • Higher acceleration, speed, wheel torque, or drivetrain load.

  • Tire, wheel, frame, fork, suspension, bearing, or fastener stress.

  • Electrical failure, short circuit, overheating, power loss, or unexpected shutdown.

  • Battery damage, thermal events, fire, explosion, smoke, or release of hazardous materials.

  • Property damage, personal injury, serious injury, or death.

  • Tickets, citations, fines, insurance disputes, registration issues, or other legal consequences.

3. Customer Responsibility

You are responsible for:

  • Providing accurate and complete information about the vehicle, its condition, prior repairs, prior modifications, battery, charger, controller, motor, and other installed components.

  • Disclosing known crashes, water exposure, battery damage, wiring changes, software changes, private tuning, speed unlocking, or other conditions that may affect diagnosis, repair, warranty, or safety.

  • Following product instructions, warnings, maintenance requirements, and written service recommendations.

  • Wearing appropriate protective equipment and operating the vehicle safely.

  • Inspecting and maintaining brakes, tires, wheels, fasteners, battery systems, wiring, controls, drivetrain components, and other safety-critical parts.

  • Using the vehicle only in lawful and appropriate environments.

  • Confirming all applicable road, trail, park, school, age, helmet, registration, licensing, insurance, and local use requirements.

Picarlo does not provide legal, insurance, engineering, registration, licensing, or professional safety advice. You are responsible for consulting qualified professionals or government authorities when needed.

4. Modification and Changed Vehicle Behavior

You understand that repair, installation, upgrade, tuning, or custom modification may change the original manufacturer configuration and may affect the vehicle’s handling, braking, acceleration, top speed, power delivery, electrical load, thermal behavior, range, component wear, and maintenance requirements.

A modified vehicle may behave differently from an unmodified vehicle, even if the modification is installed professionally.

Professional installation may reduce certain installation risks, but it does not eliminate the ordinary risks of vehicle operation, component failure, rider error, road conditions, battery use, future maintenance, or later modification.

5. Test Rides and Vehicle Handling

You authorize Picarlo employees, contractors, or authorized personnel to move, lift, inspect, power on, diagnose, test, and conduct limited test rides of the vehicle when reasonably necessary for diagnostics, installation, repair, quality control, or safety verification.

You acknowledge that test rides, electrical testing, lifting, disassembly, reassembly, and other service activities involve ordinary service-related risk. Picarlo will make reasonable efforts to handle the vehicle carefully.

You should remove personal property, valuables, loose accessories, bags, cameras, devices, and other removable items before leaving a vehicle with Picarlo. Picarlo is not responsible for lost or damaged personal property except as required by law.

6. Battery, Charging, and Storage Risks

Lithium-ion and other electric vehicle batteries, chargers, controllers, motors, wiring, connectors, and electrical components can create serious hazards if damaged, incompatible, improperly installed, modified, charged, stored, transported, or maintained.

You agree not to use damaged, swollen, wet, overheated, punctured, leaking, modified, visibly unsafe, uncertified, or mismatched electrical components.

You agree to use only compatible chargers, batteries, controllers, wiring, and connectors.

Improper charging, unattended charging, charging near combustible materials, exposure to heat or water, incorrect storage, or component mismatch may cause overheating, short circuit, fire, explosion, property damage, serious injury, or death.

Picarlo may refuse to charge, store, test, install, transport, or service a battery or electrical component that we reasonably believe is unsafe.

7. Customer-Supplied Parts

If you provide your own battery, charger, controller, motor, display, throttle, wiring harness, adapter, brake component, suspension component, drivetrain component, or other part, you acknowledge that Picarlo did not manufacture or necessarily sell that part.

Picarlo does not guarantee the safety, authenticity, certification, legality, quality, performance, or compatibility of customer-supplied parts.

Customer-supplied parts may be defective, counterfeit, mislabeled, previously damaged, internally modified, electrically incompatible, or unsuitable for the intended vehicle even if they appear physically compatible.

To the fullest extent permitted by law, Picarlo is not responsible for defects, failures, damage, fire risk, legal issues, or losses caused by or materially related to customer-supplied parts.

Picarlo may require a separate signed Customer-Supplied Parts Acknowledgment before accepting, installing, testing, or servicing customer-supplied parts.

8. High-Power and Off-Road Products

Certain products, configurations, or services may involve 1000W, 1500W, high-power controllers, speed unlocking, off-road tuning, or other high-performance modifications.

These products or configurations are not sold as guaranteed street-compliant e-bike products. They may be intended only for lawful off-road, closed-course, private-property, competition, testing, or controlled-environment use where such use is permitted.

Installing or using a high-performance product may cause a vehicle to no longer qualify as an electric bicycle and may result in additional registration, licensing, insurance, equipment, age, helmet, or other legal requirements.

Picarlo does not encourage, recommend, or authorize illegal operation on public roads, sidewalks, bike lanes, bike paths, trails, parks, school areas, or other restricted locations.

A separate signed High-Power / Off-Road Acknowledgment may be required before purchase, installation, programming, release, or service of a high-performance vehicle.

9. No Legal Advice or Road-Legality Guarantee

Picarlo does not provide legal, insurance, registration, licensing, engineering, or regulatory advice.

Any information provided by Picarlo about e-bike classifications, road use, off-road use, power limits, speed limits, helmets, age restrictions, registration, insurance, or permitted riding locations is for general informational purposes only.

You are solely responsible for confirming the laws and rules that apply to your vehicle, configuration, rider age, intended use, and riding location.

Picarlo does not guarantee that any product, service, tuning, upgrade, or modified vehicle will be legal for use on all public roads, sidewalks, bike lanes, bike paths, trails, parks, school areas, private communities, or other locations.

10. Assumption of Risk

To the fullest extent permitted by law, you knowingly and voluntarily assume the ordinary and inherent risks associated with purchasing, installing, modifying, tuning, riding, charging, storing, transporting, maintaining, and using e-bike products and modified vehicles.

You understand that some risks may arise from vehicle condition, component interaction, road or trail conditions, weather, rider behavior, third parties, battery condition, maintenance history, hidden damage, component wear, or changes made after Picarlo completes its work.

Your assumption of risk does not waive rights or remedies that cannot lawfully be waived.

11. Release and Limitation of Liability

To the fullest extent permitted by applicable law, Picarlo, AVNU Corporation, and their owners, employees, contractors, suppliers, partners, and affiliates will not be liable for losses, injuries, damages, claims, fines, penalties, insurance disputes, or third-party claims caused by or arising from:

  • Unsafe, reckless, negligent, improper, or unlawful riding or vehicle operation.

  • Use of a product or modified vehicle in a prohibited or restricted location.

  • Failure to follow instructions, warnings, maintenance requirements, or service recommendations.

  • Failure to inspect or maintain the vehicle after service or modification.

  • Accidents, crashes, impact, abuse, overloading, racing, water exposure, corrosion, fire, theft, vandalism, or neglect.

  • Unauthorized repair, disassembly, software changes, wiring changes, private tuning, speed unlocking, or further modification after Picarlo service.

  • Customer-supplied parts or incompatible batteries, chargers, controllers, motors, wiring, or electrical components.

  • Improper charging, battery storage, electrical use, or transport.

  • Known or hidden pre-existing vehicle conditions not caused by Picarlo’s workmanship.

Nothing in this Liability Waiver excludes or limits liability that cannot legally be excluded or limited. Any limitation of liability remains subject to applicable law and the specific written terms governing the product or service.

12. No Release for Picarlo-Caused Defects Where Prohibited

This website notice is not intended to release Picarlo from liability that cannot lawfully be waived, including liability that applicable law makes non-waivable.

Warranty and workmanship claims will be evaluated under Picarlo’s Warranty & Tuning Disclaimer, Warranty & Service Policy where applicable, and applicable law.

Picarlo may inspect the vehicle, parts, battery, charger, controller, wiring, photos, videos, and service records before determining whether a claimed issue was caused by Picarlo workmanship, a product defect, a pre-existing condition, customer use, a customer-supplied part, or a later modification.

13. Maintenance and Post-Service Inspection

Modified and repaired vehicles may require more frequent inspection and maintenance, especially after changes to power, speed, braking, tires, wheels, suspension, drivetrain, battery, controller, or wiring.

You are responsible for regularly checking, as applicable:

  • Brake pads, rotors, calipers, cables, hydraulic systems, and braking performance.

  • Tires, tire pressure, wheel condition, spokes, axles, and fasteners.

  • Battery condition, charger condition, electrical connectors, wiring, and unusual heat or odor.

  • Controller, display, throttle, sensors, motor, and power delivery.

  • Frame, fork, suspension, mounts, brackets, and hardware.

  • Chain, belt, gears, drivetrain, and other wear components.

Stop using the vehicle and contact Picarlo or another qualified service provider if you observe unusual noise, vibration, heat, smoke, odor, swelling, loss of braking, intermittent power, damaged wiring, cracked components, or other signs of a safety problem.

14. Warranty and Insurance Impact

Repair, tuning, upgrade, conversion, or custom modification may affect the original manufacturer’s warranty, supplier warranty, insurance coverage, resale value, or compliance with school, apartment, HOA, workplace, trail, park, or other private-property rules.

Picarlo does not guarantee that an original manufacturer, insurer, property manager, government agency, school, or other third party will accept or approve a modified vehicle.

You are responsible for reviewing applicable warranty, insurance, financing, property, and third-party terms before authorizing or using a modification.

15. Minors and Parent / Guardian Responsibility

If the customer, rider, vehicle owner, or person receiving the vehicle is a minor, Picarlo may require the involvement, approval, and signature of a parent or legal guardian.

A parent or legal guardian is responsible for reviewing the product, service, vehicle configuration, safety warnings, age requirements, riding environment, local laws, and protective equipment before allowing a minor to use the vehicle.

Picarlo may refuse high-performance, battery-related, electrical, or other higher-risk services if appropriate parent or guardian authorization is not provided.

16. Signed Waiver and Additional Acknowledgments

This website Liability Waiver is a general notice and does not replace a transaction-specific signed waiver or acknowledgment.

Picarlo may require one or more of the following before beginning work, installing parts, releasing a vehicle, or completing a high-risk transaction:

  • Service Intake & Estimate Authorization.

  • Service Authorization & Liability Waiver.

  • High-Power / Off-Road Acknowledgment.

  • Customer-Supplied Parts Acknowledgment.

  • Battery & Charger Safety Acknowledgment.

  • Pickup / Delivery Acceptance Form.

Refusal to sign a required authorization, waiver, or acknowledgment may result in Picarlo declining or stopping the applicable service or transaction.

17. Right to Refuse Unsafe or Inappropriate Work

Picarlo may refuse, stop, cancel, or limit work if we reasonably believe a vehicle, battery, component, requested configuration, intended use, or customer-supplied part is unsafe, unlawful, fraudulent, technically unsuitable, incomplete, improperly documented, or inconsistent with Picarlo policies.

Picarlo may also refuse higher-risk work when required customer information, authorization, guardian consent, payment, or signed acknowledgment is not provided.

Refusal to perform a requested modification does not mean that Picarlo has inspected or certified the vehicle for any other use.

18. Relationship to Other Picarlo Policies

This Liability Waiver should be read together with Picarlo’s Terms of Service, Privacy Policy, Return and Refund Policy, Shipping Policy, Warranty & Tuning Disclaimer, and any applicable Modification, Safety & Off-Road Disclaimer or signed acknowledgment.

If a more specific signed agreement, service authorization, checkout disclosure, quote, invoice, or policy applies to a particular issue, the more specific document will control for that issue to the extent permitted by law.

19. Severability

If any part of this Liability Waiver is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

20. Changes to This Waiver

Picarlo may update this Liability Waiver from time to time. The updated version will be posted on our website with a revised Last Updated date.

For signed service or transaction documents, the version accepted or signed for the applicable order or service may be retained as part of the relevant record where practicable.
